1 Year Limited Warranty for Trakalarm Hardware Products
Trakalarmās warranty obligations for the Trakalarm Smart Wearable Personal Safety Device are set out below.
Trakalarm warrants that the Trakalarm Core Unit (āTrakalarmā) shall be free from defects in materials and workmanship, internal electronics and sensors against manufacturing defects, under normal use and recommended storage, for a period of one (1) year, except as otherwise set forth herein (āWarranty Periodā).
For Replaceable Bands: The Warranty Period is 90 days, and coverage is strictly for defects in workmanship (e.g. a broken clasp); normal wear and tear is not covered.
Exclusions: What is NOT Covered
- Normal Wear and Tear: Any cosmetic degradation that does not affect the core safety function of the device, including but not limited to:
- Scratches, scuffs, or dents on the Trakalarm core or band.
- Discoloration, fading, or "yellowing" of bands due to sweat, sun exposure, or contact with chemicals (lotions, perfumes, detergents).
- Stretching or softening of silicone or fabric bands over time.
- User Negligence & Abuse: Damage caused by snagging the band on sharp objects, exposure to extreme temperatures >50°C or <0°C, or immersion in water beyond the deviceās IP rating.
- Third-Party Alterations: Any damage resulting from the use of non-Trakalarm bands or "hacks" to the mounting hardware.
- Battery Longevity: Like all lithium batteries, a slight decrease in maximum capacity over 12 months is normal and not a "defect."
Digital Product Disclaimer
Remote Access Service Disclaimer: "Remote Access" is provided on an "As-Is" and "As-Available" basis. Trakalarm does not warrant that the digital service will be uninterrupted or error-free.
Third-Party Networks: Trakalarm is not responsible for service failures caused by GPS signal blockage, mobile carrier outages, or the userās mobile device settings (e.g., "Do Not Disturb" mode).
Emergency Response: Trakalarm is a supplemental safety tool and is not a substitute for 000/911/999. We do not guarantee that the Remote Access feature will prevent harm, injury, or loss.
Claims & Replacement Process
Notice of a claim may be made by contacting customer service at admin@trakalarm.com.
If a defect arises and a valid claim is received within the required time period, Trakalarm will, at its option, sole discretion and to the extent permitted by law, either attempt to fix the product, replace the product with a new product, or refund the purchase price of the product. In all cases, proof of purchase may be required. When a product is replaced, any replacement item becomes the customerās property, and the replaced item becomes the property of Trakalarm.
It is the customer's responsibility to return the product being replaced to Trakalarm in a manner specified by Trakalarm, designed to prevent further damage, accidental activation, and to maintain the integrity of the product. The customer shall not return the product without obtaining a return authorisation from Trakalarm. The customer shall retain responsibility for any loss or damage until the product is received by Trakalarm. Shipping costs associated with said exchange shall be at the customer's expense.
Products replaced under warranty are covered only for the remaining balance of the original purchase warranty period; product replacement explicitly does not extend the original warranty. If a refund is warranted, said refund will only be transacted upon Trakalarmās receipt of the item, with shipping prepaid by the customer, and the product for which the refund is provided becomes Trakalarm's property.
Statutory Rights & Disclaimers
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) or the United States of America DISCLAIMER OF IMPLIED WARRANTIES AND MERCHANTABILITY (UCC).
EXCEPT AS SET FORTH ABOVE, IN THIS LIMITED WARRANTY, TRAKALARM MAKES NO WARRANTY OF ANY KIND OR NATURE, EXPRESS OR IMPLIED, WITH RESPECT TO THIS PRODUCT OR ITS MERCHANTABILITY, CONDITION, SUITABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE HEREBY EXCLUDED.
Under no circumstances shall Trakalarm be responsible for incidental or consequential damages with respect to economic loss or injury to person or property, whether as a result of breach of warranty, negligence, or otherwise. Trakalarm will not be responsible for the result of careless handling or unreasonable use, or for failure to follow instructions relating to the same. This warranty gives customers specific rights.
